About SC/ST Atrocities

The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, commonly known as the SC/ST Act, is a landmark legislation aimed at preventing atrocities against members of Scheduled Castes and Scheduled Tribes. Despite constitutional safeguards and various legal provisions, discrimination and violence against these marginalized communities continue to persist in various forms across India. Legal Framework for SC/ST Atrocities

The legal framework to address atrocities against SC/ST communities includes:

  • The Constitution of India: Articles 15, 17, and 46 specifically prohibit discrimination based on caste and provide for special protections.
  • SC/ST (Prevention of Atrocities) Act, 1989: A comprehensive legislation that defines specific offenses as atrocities and prescribes stringent punishments.
  • SC/ST (Prevention of Atrocities) Rules, 1995: Provides procedural framework for implementation of the Act including relief, rehabilitation, and compensation.
  • 2015 Amendment: Strengthened the Act by adding new categories of offenses, establishing Special Courts, and enhancing victim compensation.

Important Note

The SC/ST Act carries strict provisions for false complaints and witnesses. Section 3(2)(v) of the Act provides for enhanced punishment when offenses under the Indian Penal Code (IPC) carrying a sentence of ten years or more are committed against a person from SC/ST communities. SC/ST Atrocities FAQs

Following the SC/ST Amendment Act of 2018, anticipatory bail under Section 438 of CrPC is generally not available for offenses under the SC/ST Act. However, the Supreme Court in Prathvi Raj Chauhan v. Union of India (2020) clarified that courts still have the power to grant anticipatory bail in exceptional circumstances where prima facie there is no case or where the complaint appears to be frivolous or motivated. Each case is evaluated on its specific merits.
The SC/ST Rules provide for various relief measures including monetary compensation ranging from ₹1 lakh to ₹8.25 lakh depending on the nature of the offense. Additional relief includes medical aid, rehabilitation, legal aid, transportation facilities, and immediate relief in the form of food, water, and shelter. The compensation is provided in stages: 25% when the charge sheet is filed, 50% when the trial begins, and the remaining after conviction. Victims may also be entitled to pension, employment, and educational support.
Investigations under the SC/ST Act must be conducted by an officer not below the rank of Deputy Superintendent of Police (DSP). The investigation must be completed within 60 days, and the charge sheet must be filed within that period. The Act also mandates special courts for trial with special public prosecutors. Additionally, the Act provides for traveling and maintenance expenses for witnesses and victims during investigation and trial. Any negligence by public servants in the investigation can lead to punishment under Section 4 of the Act.
