Common Offences Under Arms Act

The Arms Act defines various offences related to illegal possession, acquisition, and use of firearms. Some of the common offences include:

  • Section 25(1)(a) - Manufacturing, selling, transferring, converting, repairing, testing, or proving any firearm or ammunition without a license. Punishable with imprisonment for a term not less than seven years but which may extend to life imprisonment and fine.
  • Section 25(1)(b) - Acquisition, possession, or carrying of any prohibited arms or prohibited ammunition without a license. Punishable with imprisonment for a term not less than seven years but which may extend to fourteen years and fine.
  • Section 25(1)(c) - Acquisition, possession, or carrying any firearm or ammunition in contravention of Section 3. Punishable with imprisonment for a term not less than three years but which may extend to seven years and fine.
  • Section 27 - Using firearms or ammunition in contravention of Section 5. Punishable with imprisonment for a term which shall not be less than seven years but which may extend to imprisonment for life and fine.
  • Section 29 - Knowingly purchasing arms from unlicensed dealer or person. Punishable with imprisonment for a term which may extend to three years, or with fine, or with both.

The punishment for illegal possession of a firearm varies depending on the type of weapon. For prohibited arms or prohibited ammunition, imprisonment ranges from 7 to 14 years with a fine. For other firearms, imprisonment ranges from 3 to 7 years with a fine. If the firearm is used in a crime, penalties are even more severe and may extend to life imprisonment.
Bail in Arms Act cases depends on several factors including the nature of the offence, quantity and type of arms recovered, criminal history of the accused, and the specific section under which charges are filed. For offences with punishment of less than 7 years, bail is more likely to be granted. For more serious offences, particularly those involving prohibited arms or ammunition, obtaining bail is challenging but not impossible with skilled legal representation.
Common defenses in Arms Act cases include: lack of knowledge or possession (arguing the accused was unaware of the presence of the firearm), challenging the search and seizure procedures, disputing the forensic reports or ballistic evidence, questioning the chain of custody of the seized arms, proving that the recovered item doesn't qualify as a firearm under the Act, establishing that proper license exists, or demonstrating that the arms were planted by someone else including law enforcement officials.
