NDPS FAQs

Penalties under the NDPS Act vary based on the quantity of the substance involved. For small quantities, imprisonment can extend to 1 year with a fine up to ₹10,000. For intermediate quantities, imprisonment can extend to 10 years with a fine up to ₹1 lakh. For commercial quantities, the punishment ranges from 10 to 20 years imprisonment and fines from ₹1 lakh to ₹2 lakh. Repeat offenders may face up to 30 years imprisonment.
While bail in NDPS cases is challenging, it is not impossible. For small quantity cases, regular bail provisions apply. For commercial quantity cases, Section 37 of the NDPS Act imposes additional conditions - the court must be satisfied that there are reasonable grounds to believe the accused is not guilty and is unlikely to commit offenses while on bail. With specialized legal representation focusing on procedural lapses or evidentiary weaknesses, bail can be secured even in serious cases.
