About POCSO Act

The Protection of Children from Sexual Offences (POCSO) Act, 2012 was enacted to protect children from offences of sexual assault, sexual harassment, and pornography. It was established to provide a child-friendly system for the trial of these offences. The Act defines a child as any person below the age of 18 years and provides protection to all children from sexual offences. The Act is gender-neutral and regards the best interests and well-being of the child as being of paramount importance at every stage to ensure the healthy physical, emotional, intellectual, and social development of the child.

Offences Under POCSO Act

The POCSO Act defines various types of sexual offences against children and prescribes stringent punishments. These offences include:

  • Penetrative Sexual Assault (Section 3) - Punishable with imprisonment of either description for a term not less than ten years but which may extend to imprisonment for life, and fine.
  • Aggravated Penetrative Sexual Assault (Section 5) - Punishable with rigorous imprisonment for a term not less than twenty years but which may extend to imprisonment for life, and fine, or with death.
  • Sexual Assault (Section 7) - Punishable with imprisonment of either description for a term not less than three years but which may extend to five years, and fine.
  • Aggravated Sexual Assault (Section 9) - Punishable with imprisonment of either description for a term not less than five years but which may extend to seven years, and fine.
  • Sexual Harassment (Section 11) - Punishable with imprisonment of either description for a term which may extend to three years and fine.
  • Using Child for Pornographic Purposes (Section 13) - Punishable with imprisonment of either description which may extend to five years and fine, and in the event of subsequent conviction, imprisonment for a term which may extend to seven years and fine.

POCSO Trial Process

POCSO cases follow a specific procedure designed to be child-friendly:

  1. Reporting - Cases must be reported to the Special Juvenile Police Unit or local police.
  2. Recording of Statement - The child's statement is recorded by a police officer not below the rank of Sub-Inspector, preferably a woman officer, at the child's residence or place of choice.
  3. Medical Examination - Medical examination of the child is conducted with the consent of the child or guardian in the presence of the parent/guardian or a person trusted by the child.
  4. Statement Before Magistrate - The child's statement is recorded by a Magistrate under Section 164 of the CrPC.
  5. Special Court Trial - The case is tried in a Special Court designated for POCSO cases.
  6. In-Camera Proceedings - The trial is conducted in-camera and the child's identity is protected throughout.
  7. Child-Friendly Measures - Special measures like screens between the child and accused, frequent breaks, and simple questioning are employed.
  8. Judgment - The Special Court delivers its judgment within one year from the date of taking cognizance of the offence.

The maximum punishment under the POCSO Act is death penalty for aggravated penetrative sexual assault, especially in cases of gang rape or assault resulting in death. Otherwise, punishments range from 3 years to life imprisonment depending on the nature and severity of the offence, along with fines.
